I have been asking the builder for a list of documents required by me to transfer my home loan from HDFC to my own bank HSBC which is giving me a better offer, I had sent my request to the builder by email and also couriered a letter on 3rd June 2010.but the manager is always delaying it on some pretext telling excuses like he has to ask their lawyers or as to how HDFC has not taken these documents earlier before giving the loan and things like that my repeated calls are not being heard by them. I now need you assistance in helping me get these documents which anyway i would need if i want to sell the property. The said property is in Somatane;PUNE it is a project called daffodils and is still with the builder as no society is formed as yet and I have made all payments. The manager also pushed my wife in to taking possession saying that it will unnecessarily attract taxes and that the builder will always assist us in case of ant discrepancy found later. of course this was a telephonic promise between the manager Mr.Pawar and my wife. I HAD PURCHASED TWO 1BHK FLATS AT KOPERKHAIRANE SECTOR-11 FROM THE PROPREITOR MR.IRFAN ISMAIL THE COST OF EACH FLAT BEING 13 LAKHS INR.I HAD GIVEN MR.IRFAN ISMAIL 14 LAKHS N PURCHASED TWO FLATS THE PAPERS WHICH HE HAD GIVEN IS WITH ME.BUT NOW HE IS NOT PRESENT AT THE SITE AND SOME OTHER PERSON WHICH HE SAYS HE IS THE PROPREITOR IS PRESENT AT THE SITE.
NOW WHEN I SHOWED HIM THE PAPERS HE SAYS THAT MR.IRFAN ISMAIL WAS NOT THE PROPREITOR HE WAS JUST HIS FRIEND.
I WENT TO THE ADVOCATE WITH WHOM THE PAPERS WERE MADE AND HE SAYS THAT HE HAD MADE POWER OF ATTORNEY IN NAME OF TWO PEOPLE ONE OF THEM BEING MR.IRFAN ISMAIL.I AM NOT THE ONLY ONE TWO MORE FAMILIES ARE ALSO INVOLVED IN SAME PROBLEM.

I, Dilip Shah, am senior citizen with age 65 years. This is a complaint against Mumbai based construction company named M/s DEV LAND AND HOUSING LTD (DLH), an ISO 9001-2000 awarded, having its Registered Office at 10th Floor, Dev Plaza, Opp. Andheri Fire Brigade, S.V.Road, Andheri (W), Mumbai. MR. VIJAY THAKORDAS THAKKAR is Chairman and Mg. Director.
In the month of June, 2009, by selling my old flat plus my life-time hard earned money added, I had booked a flat with full payment made at one stroke, in one of the upcoming residential projects of the above referred company M/s DEV LAND AND HOUSING LTD (DLH), the building known as “DEV PRESTIGE” at Veera Desai Road, Andheri (West) Mumbai 400 053. The possession is expected in Dec.2010.
Pursuant to making of full payment to the said Builder, I was requested by the him that since the building plans of the said project were in the final stage for approval with Mumbai Municipal Corporation, I should wait for some time to complete the formalities of issuance of Letter of Allotment of flat which was to be followed by execution and registration of Deed of Transfer and Assignment of the flat proposed to be allotted to me.
I thought his request being genuine and accepted to wait as I had no alternative left since I was in desperate need of flat and the full payment towards the proposed flat was already made.
After completion of waiting period of couple of months when I began the follow-up for claim of my flat in his above referred building known as “DEV PRESTIGE”, the said Builder on the pretext of one reason or the other started dilly-dally the matter and ignored/brushed-aside my repeated requests of execution of Title Documents in my favour.
I had sent numerous emails/messages; phone calls and SMS to Mr. Vijay Thakordas Thakkar, Chairman of the above Company and his advocate for completing the Specific Performance. I regret to mention here that none of my messages was replied and the said Builder continued to maintain mysterious silence over the matter without any bonafide reasons for not performing his obligations under the law.
Now, nearly more than 9 months have elapsed; till date, the said Builder has neither issued any Letter of Allotment to me identifying a specific flat, nor has executed any Deed of Transfer and Assignment of flat.
The said Builder on the pretext of one reason or the other dilly-dallied the matter and always brushed-aside my repeated requests of execution of Title Documents in my favour without any bonafide reason for not performing his obligations under the law. I am asking a question to the Supreme Authorities of Law and Order that is it not a sophisticated terrorism?
Besides all the emails and SMS sent to him preserved by me as documentary evidences, I am also holding all the original receipts for the amounts lawfully paid for the designated purpose.
The official receipts are issued by the said Builder on the printed letter heads of his Company wherein it has been clearly mentioned that the amounts so paid are towards a flat booking in the proposed residential project “DEV PRESTIGE” situate at Veera Desai Road, Andheri (West), Mumbai 400 053.
Is it not blatant abuse of various sections of MOFA, 1963 for non-fulfillment of statutory obligations, The Indian Contract Act for non-performance of his promises within a reasonable time and The Indian Penal Code for alleged criminal breach of trust and cheating?
I am at a loss to read the ulterior intentions of the said Builder or is it an aimless but an attempt of deliberate harassment to me and my family members or a sophisticated terrorism. As my family members at home are now losing their patience; I seek an instant settlement of my long pending issue without any further delay to arrest mental torture caused by so-called ISO 9001-2000 Company run by the fraudsters.
It is now proved and confirmed beyond doubt about the malicious intentions and integrity of the said Builder that over a period of more than 9 months, he has succumbed to immoral and wicked ploy to dispossess me and my family of my lawful flat in building known as “DEV PRESTIGE” for his ulterior motives to unlawfully garner the surplus profit by selling my proposed flat in his said building due to sudden spurt in cost of flats in this area of Andheri, West.
The abhorrent fact has now surfaced that why despite my repeated requests and reminders the said Builder did not reply even a single email sent by me to him and continued to defy and disregard the execution of the Title Documents.
All the emails sent to him are preserved by me besides holding all the receipts on their letter heads for the amounts lawfully paid for the designated purpose. I am a middle class family person and cannot afford the legal charges to approach the Court of Law.
I am staying in rented premises with a disturbed monthly budget. The lack of accountability and ethics in the system of law and order against such white culprits, the fact remains that no amount of retribution can make up for the trauma and mental torture that I and my family members have gone through and further how long.

Aware of CITICON ENGINEERS Ltd., 540 SAHEED NAGAR Bhubaneshwar ORISSA Reputed Builder used to publish advertisement in all oriya news paper+arrange stall facilities in religious & other public gathering area to catch the poor honest people.
In 2004/2005 I & my Family members come cross to the big stall of citicon Engineers Pvt. Ltd. Citicon about their different projects. Though the stall was in front of religious area, so we trust upon citicon & contacted to purchase land from their biggest project wings =5. (wp=5).
Mr. Amiya Roaul- Partner cum executive companion of citicon, who visited many times to us in my native village to book a plot, so we believe & booked plot by paying their entire terms & conditions along our few request terms Prior to book the plot they took to my family to show the sites of their different sites.
Actually once after you booked with them they will demand more money and play big role to claim us as defaulter and they will promise only after 3-4 weeks land register/ Demarcation will be given by office Amine though now office Amine very busy with lots of projects, which is 100% false. It is in effect using your money they will buy the land or forge the land documents and register it in your name. Also most the land papers are only power of attorney, which can be cancelled at any time by the issuer, thus making subsequent transactions invalid. They do not provide any facilities and they claim that they will provide the road which is distant possibility, forget about electricity and water…PLEASE DONOT BUY LAND FROM THEM IN ANY OF THEIR PROJECTS: SUCH RUDRA VIHAR 1 & 2, WP=1/2/3/4/5/6 Patra para, Sum City ,Sum Annex ETC I am a victim of it.
Any projects both land + flat available under CITICON ENGINEERS Ltd., 540 SAHEED NAGAR Bhubaneshwar ORISSA on basis of installment and others like outright/ net cash etc. That means they don\’t have the land. They will only show you a map and allocate a ficticious plot in your name. IF you actually go to the site there is nothing there only farm lands also conversion of land is very difficult. Please consider above points before buying a land from CITICON ENGINEERS LTD 540 SAHEED NAGAR, BHUBANESWAR making subsequent transactions invalid.
They have many offices but everybody is fooling around and their main office is at 540 SAHEED NAGAR, OPP: SAHEED SPROTING CLUB BHUBANESWAR, with branch offices at JAJPUR, PURI, GUJRAT , KOLKOTA ECT.
Me and my relatives BOOKED 8 plots in the year 2005 IN THEIR WINS PROJECT =5 (WP=5) in an installment basis amount I paid as per agreement papers done with CITICON ENGG. installments without being defaulter. BUT CITICON CLAIM THAT WE PURCHASERS are DEFAULTER. It\’s been more than 2 year they are not willing to do registration / Demarcation even though, we had sent out 4 letters to their official address through Register Post and also meet personally Many times and contacted almost every days over phone. Since more than 03 years we are ready with cash for registration and this fraud company is not willing to do registration/ Demarcation and also not replying to our letters. Owner of the company and his all companions are real cheater.
When we contacted regarding the same, CITICON ENGINEERS LTD assured with false hope that we will fix your plot once everything is cooled down from the landlord some deals and you will get your plots as per agreement. I had personally gone to CITICON ENGG. Ltd office at BBSR and while discussing about my registration and possession of my land, they had told these lands YOU WILL GET NEXT DAY/WEEKS/ MONTHS in this way many years passed but no result yet. When we approached & meet the Chairman/MD, CITICON he gave us lame excuses and assured the safety of our money land every things. I had spent all MY WHOLE LIFE’S earnings to purchase the LAND from CITICON ENGINEERS Ltd. 540 Saheed Nagar, BHUBANESWAR. ORISSA.
Before buying plots from CITICON ENGINEERS Ltd, BHUBANESWAR they will behave as if that they are your relatives and behave with you very good manner. They will behave in a good ways until we complete their installments. Once installment or land Registration over with this Citicon, they will see their real face and we will feel that we cheat to them.
Why I wrote this big letter is too aware you guys before buying land from CITICON ENGINEERS Ltd. 540 Saheed Nagar, BHUBANESWAR. ORISSA. I am is Victim of this fraud.
