Cheat & Fraud – Non delivery of the car and delay in refund of booking amount

August 17th, 2010

Name: Vishal Gupta

Defaulting Company: A1 Hyundai, Saki Naka, Mumbai

This complaint refers to non-delivery of car and non-refund of booking amount by Hyundai’s authorized dealer – A1 Hyundai.

I have booked a car (Hyundai i10 Asta 1.2 WS GLS AT) from A1 Hyundai, Saki Naka, Andheri, Mumbai showroom on July 4th in my wife’s name (Anu Goyal) and paid an advance of Rs. 50,000/- by cheque number 113532 dated 4/7/10 drawn on HSBC Bank.

However, even after waiting for 32 days for the delivery, A1 Hyundai failed to get an allotment of the vehicle from Hyundai and kept making false promises.
On August 6, I asked the dealer (Mr. Lucky) to cancel the booking and refund the booking amount and the dealer agreed to refund the full money within 8-10 days. However, now the dealer is not even refunding that booking amount citing that there are no funds in the account.

On speaking to spoke to Hyundai’s sales support, Ms. Juanita (022-40969035), on August 17, I came to know that Hyundai is not giving allocation of cars to A1 Hyundai for lat 8-10 months. But still A1 Hyundai is legally and formally an authorized dealer of Hyundai and same is endorsed on Hyundai’s website.

A1 Hyundai is conducting a big fraud by continuously taking money from innocent customers in the heart of Mumbai and I am surprised Hyundai is not doing anything about it. No doubt I strongly feel A1 can’t commit such fraud without an active involvement of some higher people within Hyundai.

I have already spoken to Hyundai’s customer care several times (Mr. Nitesh, complaint number 1-36274445) on August 13, Ms. Manpreet on August 16 and Mr. Anirudh on August 17 but it was of no help.

I have made the booking putting my trust in Hyundai brand name, but never expected that they have such crooks representing them as their dealers.

I request you to please advice how can I get my refund of my booking amount from them

Regards,
Vishal Gupta
