I Babu Alexander on behalf my daughter Mrs.Bhavana babu, owner of Maruti /Ritz (Registration No.TN/20/BX/4704 at Chennai) making this representation. The Vehicle was purchased from M/s. Crescent Auto Repairs & Services India Pvt Ltd (Authorised Maruti Dealer), No.9. Cenotaph Road, CHENNAI-600 018, from their newly opened show room at Valasaravakkam. Invoice No. VSL 09000786 dated 18-07-2009.
I was driving the above vehicle on 31st after noon, when I was returning home for lunch around 12.30 pm, near my house there was a water log due to recent rain. I was very slow and while I was crossing the water log, a small stone hit the front bottom of my vehicle, and suddenly I could see only smoke coming up. I got down from the vehicle and saw oil spilled up all over. On the dash board also indicator lamp was burning, I left the vehicle on the spot and immediately called up the Popular Vehicle and services Ltd Chennai, care service (the first two services was carried out by the above firm only). Their service vehic le came around 3 pm and the mechanic cranked the vehicle to the centre of the road and towed the vehicle to their Body Shop ay Virugam bakkam. On first being the holiday, the 2nd after my repeated follow up evening around 4pm the service people from the body shop called me and my daughter to come to the service centre (body shop) to sign the Insurance claim. However I am surprised to note that , though I was urgently called by the Manager, Popular Vehicles and Services Ltd, Body Shop, at Virgambakkam, and obtained my daughters signature on the Insurance claim form on 2nd Jan-2010 evening, the claim was preferred to M/s. Bajaj Akllianze General Insurance, office only on 7th Jan-2010, which was a total negligence on the part of the M/s Popular Vehicles and Services Ltd, Body Shop, at Virgambakkam.
Though they promised me that they would keep me informed of the position, till 7th no feed back was received from the service person. On my follow up to day morning with Srikumar-Manager, around 12.30 pm the Insurance Survivor from Bajaj Alliance General insurance co. Ltd ( Certificate Cum policy No. BA5049779) & (the Claim No. OC10-1501-1801-000-13863) called me up and said since the estimation given by the service people was for Engine jam, which the Bajaj Alliance General insurance co. Ltd has rejected. I also received a call from Mr.Srikumar-Manager around 1.30pm and asked me to come to body shop and he has taken a signature on my claim form with a remark as “claim rejected and the repair to be carried at the cost of customer) I have signed the claim as I want the vehicle back early.
The argument of the Insurance is that “The damage to engine inner components were not due to any accidental external means, but coming under the consequential loss” is not correct. Here the damage to engine components was due to the accident impact only and damage to the oil seal, which resulted in seizure of engine inner components, It is more or less like damage to inner parts of car / injury to the passenger / driver due to impact of an accident / hit. However whether the engine jam was really happened has to be assessed, and if so, in the given circumstances as confirmed by my father and me, could it be possible to have happened due to the negligence of the driver or other wise could it have happened at the hands of the workshop subsequently, on the fact even though the insurance claim form was signed by me in the presence of the Manager on 2nd Jan-2010 evening, and I am surprised to note that claim was preferred only on 7th Jan-2010 to the Insurer after due follow up from my side and my fathers side. The Engine seizure if at all happened, possibly could have happened when the car was running and when suddenly engine oil due to accident impact drained fully all of a sudden, has to be ascertained with due diligence and needs an expert opinion, and warrants legal remedy and further enquiry should be made at your end.
I have made representation to Customer care- Maruti/ Bajaj Alliance General Insurance/ Popular Vehicle and services Ltd Chennai & Cochin. Though I have made it clear to M/s. Popular Vehicle and Services Ltd Chennai, that I need the vehicle and I would making the payment without prejudice to my right to approach appropriate legal forum for claim, till to day I have not received my vehicle.
Kindly help us, if possible from your end or may kindly forwarded to the appropriate section for redresses of my claim / and to have the vehicle repaired under your supervision as it is in warranty.

the claim form since the Insurance rejected the original claim. They also made an endorsement as “claim rejected and the repair to be carried at the cost of customer). I signed the claim as I wanted the vehicle back early.
The insurance company rejected the claim on the ground that “The damage to engine inner components were not due to any accidental external means, but coming under the consequential loss”. This would not be the correct position and the rejection of the claim by the insurance company cannot be sustained on this ground. Here the damage to engine components were due to the impact of the vehicle hitting the stone thereby resulting in damage to the oil seal, which in turn resulted in seizure of the inner components of the engine. It is more or less like damage to inner parts of car / injury to the passenger / driver due to impact of an accident / hit. However, whether the engine was really jammed or not has to be assessed. If it is found that the engine ceased, it could have happened after the vehicle was taken to the workshop by the service personnel and probably due to the negligence on the part of the service personnel. It is also pertinent to mention that though I had signed the claim form on 2.1.2010, the same was forwarded to the insurance company only on 7.1.2010 that too only after I personally intervened.
I have made a representation on the whole issue to the Customer care- Maruti/ Bajaj Alliance General Insurance/ Popular Vehicle and services Ltd Chennai & Cochin. I have made it clear to M/s. Popular Vehicle and Services Ltd Chennai, that since I had an urgent need for the vehicle, I would be making the payment without prejudice to my right to approach appropriate legal forum for claim. Though the initial letter dated 19-01-2010, from Bajaj Alliance General Insurance had rejected my claim, vide their letter dated 11-02-2010 the insurance company has confirmed to my daughter that they would be approving the claim partially under certain heads. The statement reads as follows “The claim has been given for Rs.4261/- according to the terms and conditions of the

policy as under
Approval has been given for the following
1) Replacement of Oil sump, painting of front bumper assembly
2) There is no external damages found in engine assembly and damages to the engine inner components are not due to any accidental means, but coming under the consequential loss”
The Vehicle was delivered to me after repair during the second week of February. While I was taking delivery of the vehicle, I was surprised to note that the insurance has approved another claim for certain painting works and removal of certain dent on the front bumper, and front portion of my vehicle, which was not included in my original claim nor claimed by me / daughter. I noticed the entire front bonnet and bomber portion have been repainted. Where as the claim from me was only for a hit at the bottom of the engine, resulting in oil spillage all over. The break down vehicle when collected the vehicle from the spot of accident did not make a mention about the damage on the front portion of the vehicle. The question of repairing the front portion, the front bumper & painting was presumably an understanding between the insurer and the service people, which is unclaimed and un warranted and may be with some ulterior motive to cover up some damage happened in between.
I therefore pray that the grievance cell may be pleased to enquire into the matter regarding the rejection of the claim dated 2.1.2010 and also the subsequent claim submitted by M/s. Popular Vehicle and services Ltd and also to direct M/s.Bajaj Alliance General Insurance to make payment of the amounts paid by me and thus render justice. Copies of the letters received from Bajaj Allianze are enclosed.
