FAULTY SAMSUNG STAR HANDSET

Had bought a new Samsung Star (Model# S5233A, RSN# 354369030771951) from a shop (Jenil Electronics – shop No.4, Vasundhra, “Vikrant Circle”, Tilak Road, Ghatkopar (E), Mumbai- 400 077. Tel# 25131086, 25140621) on 9th SEP 2009. The very next day I was facing problem with the network and in opening of the camera function. Than we showed the handset to the Samsung service center (Jameson Telecom Services, opp Shreyas Theatre LBS marg, Ghatkopar (W), Tel# 65275095 / 25004008 ). The engineer examined the handset for 4 days and informed us that the camera function problem is resolved as they have to replace the camera but the network problem is still there as the motherboard of the handset is found to be faulty. After which he issued us the SAMSUNG DEAD ON ARRIVAL MOBILE PHONE CERTIFICATE (DOA Certificate no. SIELG2009091507428Y; DOA Issue Date: 15/09/2009) and asked us to exchange the handset from where it was purchased by showing the DOA letter. However till date twice we went to the shop (Jenil Electronics) and a fight but the shopkeeper had refused us to exchange the handset giving us the reason that there duty is to sell the handset and the warranty is given by manufacturer (i.e. SAMSUNG) so the Samsung mobile company should replace the mobile. Than again we need to visit the service center, the engineer (Ganesh – 9321397416) had a chat with the shopkeeper on phone but the answer from the shopkeeper was the same. The engineer than had apologies to us saying he cannot do anything further.
Than we decided to file a case against the shop and the service center in the police station at Ghatkopar (E), but even the cops refused the same (no reason was given to us).
Now actually no one knows where the customer should go in such kind of situation other than consumer court.
Currently the bill (which includes VAT in it) and the DOA letter is with us but dont know what to do with it.

Procedure of filing a Consumer Complaint
1. Send a notice to the opposite party giving him/her time limit to settle your grievance. This is however not compulsory.
2. Prepare the consumer complaint by writing your grievance. Quote bill no item detail etc. Attach bills. Also attach photocopies of cheques through which payment has been made etc if you have them. Attach photocopies of warranty card, other supporting documents that you may have.
3. Get the complaint affidavit attested by a notary.
4. Make required number of photocopies.
5. Prepare a bank draft from a nationalized bank or postal order from post office in name of president of district consumer court of your district to pay court fees of Rs 100 in your case.
6. Submit the complaint and court fee to the receiving clerk in the consumer court who will give you the date for admission hearing and a reference number of the complaint. You may hire a competent lawyer if you think so but you can fight on your own also.
7. On admission hearing, you would be informed whether your case is fit for acceptance or not. If your case is accepted, you will be given the date of next hearing.
8. The court will send a notice with your complaint copy to the opposite party seeking reply within 30 days, and asking him/her to attend the hearing.
9. The hearings will continue till the matter is decided.
10. The courts final order will be sent to all the parties by registered post or you may collect it in person from the court.
