Hi,
We have worked for a company for around 3 years. the company deducted certain amount from our salary as PF. now the company does’t exists. its buisness has been taken over by another company. when we try to withdraw our PF from EPFO office, its found that the mount in aour account is very less than what was deducted from our salay. Also our application to withdraw is rejected stating the reason “Signature mismatch”
now we can not take the new signature as the concerned persons are out of country. Can we register a case in cosumer court for issues such as this ?
1) Unfortunately you cannot file a case in the consumer court in this regard.
2) You will have to file a case in a civil/labour court to get your dues.
3)See if the employees can get together and file an FIR under section 420 etc. against the erstwhile employer. If the police does not lodge an FIR, you can file a criminal complaint in the case. Civil case and criminal case will continue separatly.
4) Also ask your lawyer to see if the new company can be held liable. Depends on their terms and conditions of takeover.

As the above mentioned subject I request you to resolve my problem. I resigned on 30th Dec 2008 after that I completed all the formalities regarding PF. I called Thanes PF office they told me that these
a) 522065 b) 1382087 (Issued on 31/05/2009) are your checks numbers and we sent to the respective Brach of Bank (HDFC Banks). I personally visited to the Brach of bank & enquiry they told me they didnt receive any checks Below I have mentioned all the Details .Neither me nor bank received any letter regarding PF(PF statement) .Please see and do the needful. Now a days I am facing monetary problems.

Mr Sailesh,
You should get it in writing from HDFC bank that they have not received the above mentioned cheques. On that basis you can ask the PF office to cancel those cheques and issue new ones. Also see if you can visit the PF office and verify the despatch no of the cheques they claim to have sent.

It seems that your company may not have deposited the provident fund of employees with the PF office. Are you sure that they deducted money from your salary to deposit in your provident fund account?
If the company deducted money from your salary but did not deposit in your PF account, then the company has embezzled your money. It is a serious mistake and you can go to the police station and file a complaint and also pursue the case in the civil courts. However, you will have to wait for your PF amount and there seems no alternative except if you can pressurise the company to make the payment or face punishment. But first make sure the money was to be put in your PF by the company or not.
It’s been almost 6 months that I had left WNS (resigne in June 2008). Till date I have not received my PF amount.

I had resigned from my company in the month of June 2009 and the PF form was send by my HR to the PF office at Thane on 5th October 2009.

I have checked the updated site “04/01/2010″ and it is showing claim “Your claim not received”.
Please let me know how to find the status of my claim as I have been trying the PF telephone number of Thane office but they are not picking up the phone. Since I am working currently in Chennai I am unable to check personally the office at Thane.

The best thing would be if you can send somebody else like your friend or ex-colleague at Thane to check it with the PF office. If your company had sent it then maybe the PF office is sleeping on it. ALSO you can look for Public Information Officer of Thane exchange on EPFindia.com and send an RTI. If you cant visit the office sending an RTI would be most suitable for you.

Dear Sir,
During my resignation period I had submitted all the relevant details to the co for claim of my EPF. Further to my surprise I have come to know that Co. for last financial yr i.e. 2008-2009 and also 2009-2010(from April – Sept) have not deposited EPF. My EPF No. AP/22276/93. I dont have any concrete proof. Even the other employees who are presently working are scared of the management to talk to me and give relevant details.
Further it is now more then six months and Head of the company (Managing Director) always gives reply “some problem has cropped up and matter will resolved very soon and also I shall hear from them very soon.) Managing Director is not ready to give me any concrete date.
Further I cheked the status of the claim online, it says my claim has not been submitted yet to PF office.
In this case how am I supposed to claim my EPF.
If not mistaken a company has not paid PF office isnt the co. liable for penalty or some punishment.

I received letter dated 2/11/2007 from the thane office regarding my PF beneifts . This letter shows sum amount RS 23489 and RS 10254 respectively with out mentioning cheque no and date. I submitted the application on sept 2006.
Till date the mentioned amount not credited my bank a/c. what happened my PF benefits. I sent scan copy of the letter which received from thane office. But i did’t get reply . I submitted application before 31 months . Till date I did’t get correct infermation.
Kindly verify the status and do the needful for getting my PF benefit.

I checked your claim status on epf website. It says claim not received. Maybe they have not processed your claims and so no cheques have been isssued. I suggest you visit the PF office personally or send someone on your behalf. Also ask your company on which date did they sent your claim to the PF office.

I worked for ICICI from June 2006 to August 2007. I want to know the status of the EPS claim of my account as ICICI people have confirmed that they have sent the settlement form to Mumbai RPFC office on 10/07/09. I have the scanned copy of the acknowledgement sent to RPFC office Regional P.F. Commissioner, 341, Bandra East office Mumbai-400051.
They said it takes 6 months for the settlement and its been around 1 year.Kindly let me know about the status of my pension claim.
I tried calling to all the phone numbers but none pick up the phone and I have sent many letters to them as I cannot go personally to Mumbai since I stay in hyderabad.
Please help me.
